The words of which the initial letter is capitalised have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.
For the purposes of these Terms and Conditions:
Affiliate means an entity that controls, is controlled by or is under common control with a party, where “control” means ownership of 50% or more of the shares, equity interest or other securities entitled to vote for the election of directors or other managing authority.
Account means a unique account created for You to access our Service or parts of our Service.
Company (referred to as either “the Company”, “We”, “Us” or “Our” in this Agreement) refers to Australians for Science and Freedom Limited, Level 3, 210 Albert Road, South Melbourne VIC 3205. Australian Company Number 664 313 160.
Country refers to Australia, with the governing jurisdiction being the State of Victoria.
Device means any device that can access the Service such as a computer, a mobile phone or a digital tablet.
Goods refer to the items offered for sale on the Service.
Membership refers to any paid or unpaid membership tier offered by the Company that grants access to specific benefits, content or community features as described on the Website.
Orders mean a request by You to purchase Goods from Us.
Service refers to the Website.
Subscriptions refer to services or access to the Service offered on a recurring basis by the Company to You.
Terms and Conditions (also referred to as “Terms”) mean these Terms and Conditions that form the entire agreement between You and the Company regarding the use of the Service.
Third-party Social Media Service means any services or content (including data, information, products or services) provided by a third party that may be displayed, included or made available by the Service.
Website refers to the Australians for Science and Freedom Limited website, accessible from https://scienceandfreedom.org
You means the individual accessing or using the Service, or the company or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.
These are the Terms and Conditions governing the use of this Service and the agreement that operates between You and the Company. These Terms and Conditions set out the rights and obligations of all users regarding the use of the Service.
Your access to and use of the Service is conditioned on Your acceptance of and compliance with these Terms and Conditions. These Terms and Conditions apply to all visitors, users and others who access or use the Service.
By accessing or using the Service, You agree to be bound by these Terms and Conditions. If You disagree with any part of these Terms and Conditions, You may not access the Service.
You represent that You are over the age of 18. The Company does not permit those under 18 to use the Service.
Your access to and use of the Service is also conditioned on Your acceptance of and compliance with the Privacy Policy of the Company. Our Privacy Policy describes Our policies and procedures on the collection, use and disclosure of Your personal information when You use the Website, and tells You about Your privacy rights and how the law protects You. Please read Our Privacy Policy carefully before using Our Service.
By placing an Order for Goods through the Service, You warrant that You are legally capable of entering into binding contracts.
If You wish to place an Order for Goods available on the Service, You may be asked to supply certain information relevant to Your Order including, without limitation, Your name, Your email address, Your phone number, Your payment details, Your billing address, and Your shipping information.
You represent and warrant that: (i) You have the legal right to use any credit or debit card(s) or other payment method(s) in connection with any Order; and (ii) the information You supply to Us is true, correct and complete.
By submitting such information, You grant Us the right to provide the information to third-party payment processors for the purpose of facilitating the completion of Your Order.
We reserve the right to refuse or cancel Your Order at any time for reasons including but not limited to: goods availability, errors in the description or prices for Goods, or errors in Your Order. We reserve the right to refuse or cancel Your Order if fraud or an unauthorised or illegal transaction is suspected.
Any Goods You purchase can only be returned in accordance with these Terms and Conditions and Our Returns and Refunds Policy, which forms part of these Terms and Conditions.
Your right to cancel an Order only applies to Goods that are returned in the same condition as You received them, including all product instructions, documents and original packaging. Goods that are damaged, unsealed, or not in the same condition as received will not be refunded.
We will reimburse You no later than 14 days from the day on which We receive the returned Goods using the same means of payment as You used for the Order.
You will not have any right to cancel an Order for the following:
We are continually updating Our offerings on the Service. Goods may be mispriced, described inaccurately, or unavailable, and We may experience delays in updating information. We reserve the right to change or update information and to correct errors, inaccuracies, or omissions at any time without prior notice.
The Company reserves the right to revise its prices at any time prior to accepting an Order. Prices may also be revised following acceptance of an Order in the event of occurrences beyond the control of the Company, in which case You will have the right to cancel Your Order.
All Goods purchased are subject to a one-time payment unless otherwise specified. Payment may be made through the payment methods available on the Service at the time of purchase. Payment cards are subject to validation checks and authorisation by Your card issuer. If authorisation is not received, We will not be liable for any delay or non-delivery.
The Company may offer one or more Membership tiers, each with defined benefits, access levels and pricing as described on the Website. Membership benefits are subject to change with reasonable prior notice.
Membership is open to individuals aged 18 years and over who agree to these Terms and Conditions and the Company’s stated values and principles.
You may cancel Your Membership at any time through Your Account settings or by contacting Us. Cancellation will take effect at the end of the current billing period. No refund will be issued for the remaining portion of a paid membership period unless required by law.
The Company reserves the right to suspend or terminate a Membership where a member’s conduct is inconsistent with the Company’s values, these Terms, or applicable law.
The Company offers an opt-in matchmaking service (“ASF Matchmaking”) to members and registered users of the Website. Participation in this service is entirely voluntary and does not form part of any membership or subscription.
By submitting a matchmaking profile, You agree to the participation expectations set out on the matchmaking page, including engaging in a minimum of three in-person or virtual meetings with any match You agree to meet, and communicating promptly and respectfully with Your match and the ASF Matchmaking team throughout the process.
The collection, use, storage and sharing of personal and sensitive information submitted through the matchmaking form is governed by the Matchmaking Service section of Our Privacy Policy, which forms part of these Terms and Conditions. By participating in the ASF Matchmaking service, You confirm that You have read and understood that section of the Privacy Policy and consent to Your information being handled accordingly.
The Company provides the ASF Matchmaking service in good faith as a community initiative. The Company makes no representations or warranties regarding the suitability, compatibility or availability of matches, and does not guarantee that You will be matched with any other participant.
You may withdraw from the ASF Matchmaking service at any time by contacting matchmaking@scienceandfreedom.org. Withdrawal from the matchmaking service does not affect Your general membership or Account with ASF.
Some parts of the Service are available only with a paid Subscription. You will be billed in advance on a recurring and periodic basis (such as monthly or annually), depending on the plan You select.
At the end of each period, Your Subscription will automatically renew under the same conditions unless You cancel it or the Company cancels it.
You may cancel Your Subscription renewal through Your Account settings or by contacting the Company. You will not receive a refund for fees already paid for the current Subscription period, and You may continue to access the Service until the end of that period.
The Company may modify Subscription fees at any time. Any change will become effective at the end of the current Subscription period. We will provide reasonable prior notice of any fee change. Your continued use of the Service after the change constitutes Your agreement to the modified fee.
Except where required by law or the Australian Consumer Law, paid Subscription fees are non-refundable. Certain refund requests may be considered on a case-by-case basis at the Company’s sole discretion.
When You create an Account with Us, You must provide accurate, complete and current information. Failure to do so constitutes a breach of these Terms and may result in immediate termination of Your Account.
You are responsible for safeguarding Your password and for all activities or actions taken under Your Account. You agree not to disclose Your password to any third party and must notify Us immediately upon becoming aware of any breach of security or unauthorised use of Your Account.
You may not use a username that is the name of another person or entity, a name subject to the rights of another party, or a name that is offensive, vulgar or obscene.
The Company implements commercially reasonable technical and organisational security measures — including encrypted data transmission (SSL/TLS), web application firewall (WAF) protection, brute force login prevention, and access-controlled data storage — to protect information submitted via this website.
However, no method of transmission over the internet or method of electronic storage is 100% secure. While We strive to protect Your information using industry-standard measures, We cannot guarantee its absolute security. By using the Service, You acknowledge and accept this inherent risk.
In the event of a data breach that is likely to result in serious harm to any affected individual, the Company will take steps to notify affected parties and the relevant authorities in accordance with applicable Australian law.
The Service and its original content (excluding content provided by You or other users), features and functionality are and will remain the exclusive property of the Company and its licensors. The Service is protected by copyright, trademark and other laws of Australia and applicable foreign jurisdictions.
Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of the Company.

Our Service may contain links to third-party websites or services that are not owned or controlled by the Company. We have no control over and assume no responsibility for the content, privacy policies or practices of any third-party websites. We strongly advise You to read the terms and conditions and privacy policies of any third-party websites You visit.
Nothing in these Terms and Conditions is intended to exclude, restrict or modify any rights You may have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other applicable legislation that cannot be lawfully excluded. Where statutory guarantees apply, the Company’s liability is limited to the extent permitted by law.
We may terminate or suspend Your Account immediately, without prior notice or liability, for any reason, including if You breach these Terms and Conditions. Upon termination, Your right to use the Service will cease immediately. If You wish to terminate Your Account, You may discontinue using the Service or contact Us directly.
To the maximum extent permitted by applicable law, the entire liability of the Company and any of its suppliers under any provision of these Terms shall be limited to the amount actually paid by You through the Service in the 12 months preceding the claim, or 100 AUD if You have not made any purchases through the Service.
To the maximum extent permitted by law, the Company shall not be liable for any special, incidental, indirect or consequential damages whatsoever, including but not limited to loss of profits, loss of data, business interruption or personal injury, arising out of or in connection with Your use of or inability to use the Service.
In relation to the ASF Matchmaking service specifically, the Company is not responsible for and shall not be liable for the actions, conduct, statements or behaviour of any person You are introduced to through the service. Any interactions, meetings or relationships that arise from a matchmaking introduction are entirely at Your own risk. The Company’s role is limited to facilitating introductions between consenting participants and does not extend to any events or outcomes arising after such introductions are made.
Nothing in this clause limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.
The Service is provided to You “AS IS” and “AS AVAILABLE” with all faults and without warranty of any kind. To the maximum extent permitted by applicable law, the Company expressly disclaims all warranties, whether express, implied, statutory or otherwise, including all implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
The Company does not warrant that the Service will meet Your requirements, be uninterrupted, error-free, or free from viruses or other harmful components.
Some jurisdictions do not allow the exclusion of certain types of warranties, so some of the above exclusions may not apply to You.
These Terms shall be governed by and construed in accordance with the laws of the State of Victoria, Australia, without regard to its conflict of law provisions.
If You have a concern or dispute about the Service, You agree to first attempt to resolve it informally by contacting the Company. If the dispute cannot be resolved informally, it shall be subject to the jurisdiction of the courts of Victoria, Australia.
If any provision of these Terms is held to be unenforceable or invalid, it will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect. The failure by the Company to exercise a right or enforce an obligation under these Terms shall not constitute a waiver of that right or obligation.
We reserve the right to modify or replace these Terms at any time. If a revision is material, We will make reasonable efforts to provide at least 30 days’ notice prior to the new terms taking effect. What constitutes a material change will be determined at Our sole discretion.
By continuing to access or use Our Service after revisions become effective, You agree to be bound by the revised Terms. If You do not agree to the new Terms, please stop using the Service.
